Terms and Conditions of Service

1. Definitions

1.1. General rules for e-commerce (hereinafter - the Rules) - general conditions, determining the rights and responsibilities for the seller and the customer; also other provisions, related with online store THERA.LT.

1.2 . THERA.LT - online store, where seller offers and customer can buy the items.

1.3. Seller - established under the laws of the Republic of Lithuania UAB Žmogaus psichologijos studija (Human psychology studio), code  300561755 , registered address: Vieškūnų 19-2, Kaunas, LT 51432, Lithuania. Customer service e- mail address: info@thera.lt, web address: THERA.LT

1.4. Customer - the person, who complies with these Rules 2.2 . requirements and is buying the items at online store THERA.LT .

1.5. Purchase and Sale Agreement - made between the customer and the seller.

2. General Provisions

2.1. With this purchase and sale agreement the seller is obligated to sell and deliver the items to the customer, and the customer agrees to receive and pay for the item specific amount of money, and to pay the costs of delivery.

2.2 . To buy in THERA.LT online can a person who:

2.2.1. is 18 years and older;

2.2.2 . persons from 14 to 18 years with adult consent and supervision (except cases when a person has his own income and disposes it);

2.2.3 . companies.

3. Customer rights

3.1. The customer has the right to purchase items online store THERA.LT according these Rules and online store rules.

3.2. The customer has the right to refuse purchasing bag quality item or ask to replace faulty items to good ones, notifying the seller no later than 7 (seven) days after delivery of the item . According to local laws (in 2001 Minister of Economy signed law), such items as books, toys and games are non-refundable and non-changeable.

3.3. In case of refusing or replacing the item, the customer must send an email to mailbox info@thera.lt, specifying the item and the order number.

3.4. The customer can apply to the rights, mentioned in 3.2. only if the item was not damaged or significantly change its appearance  - if the item was not used.

4. Customer's Responsibility

4.1. The customer must pay for the items according to these Rules.

4.2. The customer agrees not to give to anyonehis login information.

4.3. If customer's personal information has changed, it is required to update the data.

4.4. The customer agrees to operate accordong to these Rules, and THERA.LT online shop conditions and Lithuanian law.

5. Seller's rights

5.1. If the customer is trying to damage THERA.LT e-shop job stability and security, or breaks his responsibilities, the seller has the right to immediately and without notice suspend or restrict access to the customer THERA.LT online store, or in exceptional cases, eliminate the registration of the customer.

5.2 . In case of serious circumstances, the seller may suspend or terminate THERA.LT electronic store operations, with no prior notification to the customer.

5.3. If the customer schooses the 8.2.1 or 8.2.3 method of payment and does not pay during 3 (three) working days, the seller will have the right to cancel the order without prior notice to the customer .

6. Seller's Responsibility

6.1. Seller agrees according these Rules and THERA.LT online shop conditions to make possibilities for the customers to access THERA.LT services.

6.2. Seller agrees to deliver the ordered items to the given address according 9 paragraph of the Rules.

6.3. If the seller is not able to deliver ordered item, he is obliged to offer similar item. If customer refuses refuses to take this similar item, the seller agrees to refund the paid money within three (3) working days .

7. Signing Purchase and Sale Agreement

7.1. The agreement between the customer and the seller is signed from the moment when the customer selects items, forms shopping cart and clicks the button "Confirm order" . Without this approval, order processing is not available.

7.2. Each order (purchase and sale agreement) is recorded and stored in THERA.LT database. Customer can register online and see purchase history.

8. Prices, payment methods and terms

8.1. Prices in THERA.LT online store are in lithuanian litas (ltl) and calculated with taxes (VAT inclusive).

8.2. Customers can pay for the orders in one of the following ways :

8.2.1. bank transfer - when customer gets and prints the order and can transfer the money at home or in the bank, post offices, etc.

8.2.2. pay in cash if come to our stores (addresses and working hours are on THERA.LT webpage) .

8.2.3. Online payment (in collaboration with our partner company mokejimai.lt  - EVP International, company code 300060819) - the payment is made using customer's online banking system.

8.3. In case of 8.2.1 and 8.2.3 payment methods the customer is obliged to pay immediately. According to the Rules 5.4., the seller shal start collecting the order and delivery only upon receipt of payment.

8.4. Seller is not responsible for timely payment transactions in accordance with these Rules 8.2.1 and 8.2.3 .

9. Delivery

9.1. Ordering the items, customer must specify the place of delivery .

9.2. The customer is responsible to receive items personally himself, If he is not able to receive himself and the items are delivered to the specified address, the customer can not claim that items were delivered to the wrong address.

9.3. Seller delivers the items himself, or sends an authorized representative.

9.4. The seller is responsible to deliver the items to the customer according to the descriptions of the terms. These terms do not apply in cases when the an item is out of stock and the customer is informed about this. Also the customer agrees that in exceptional case, delivery may be delayed due to unexpected circumstances. In this case seller is responsible to contact the customer immediately and coordinate delivery issues.

9.5. In all cases the seller is released from responsibilities regarding delivery if this happens due to the customer's fault.

9.6. On delivery customer also gets the invoice in written or electronic (e-mail) form. This invoice is considered as warranty sheet as well.

9.7. On delivery the customer has to check the packaging status. If the customer sings that the order was delivered, it is considered that it was delivered in good shape. If the package is damaged, this should be noted in delivery document. If customer fails tonote this, the seller is relieved from responsibility to the customer regarding items damage, refund or replace.


9.8. Delivery fee is calculated according to the weight. In the case when customer according to 3.2 refuses the agreement, he is obligated to pay to the seller all the delivery and refund cost. The seller will deduct this cost from refund and pay the refund to the customer within 15 (fifteen) working days.

10. Product quality

10.1. All product qualities in THERA.LT online shop are specified on the website .

10.2. Seller is not responsible if customers display features differ and this distorts color, shape and other parameters.

11. Returns and replacements

11.1. Return and replacement of items are regulated accordong to Lithuanian law.

11.2. Returning the item customer has to send back an item togehter with returning document (this can be done via e-mail as well).

11.3. According paragraph 3.2. customer can use his right within 7 (seven) working days from the date of receiving the items.

11.4. Money for returned items are transfered within 3 working days.

11.5. Returning the items is important:

11.5.1 . the item must be in its original packaging;

11.5.2 . the item must be not damaged;

11.5.3 . the item must be in good condition (with labels, etc) - this does not apply if the detective item is returned;

11.5.4 . the returned item must be in the same configuration as it was received by the customer;

11.5.5 . when returning it is necessary to note order number, specify the item and the reason of returning.

11.6. If customer fails to comply with these rules, the seller has the right not to accept returned items.
 
12. Responsibilities

12.1. The customer is responsible for the booking form and the information in it. In the case of faulty information the seller can be not able to process the delivery.

12.2. Customer is responsible for his actions using THERA.LT online shop system .

12.3. The customer is responsible for his login information and is advised not to give this information to other persons.

12.4. If the customer is not following these recommendations and is not familiar with these rules, the seller is not responsible for any loss.

12.5. If on THERA.LT webpage are some links to other companies, organizations or individual websites, the seller is not responsible for the information on these links, he does not monitor or control these websites.

12.6. The damage should be recovered by the guilty part.

13. Protection of personal data

13.1. The customer agrees to give his personal data to the seller for keeping and updating.

13.2. Seller receives and operates with personal data: name, family name, the actual residence address, phone number, mobile phone number, payment history and other data.

13.3. The customer confirms that he is familiar with personal data processing conditions and shall have the following rights:

13.3.1. access to his data, check information and ask for corrections or updates;

13.3.2 . to object for using his personal data for direct marketing purposes.

13.4. Customer can ask for corrections or removal of his personal data coming to our stores  or via e-mail.

13.5. The seller is responsible to take care about personal data security, implement appropriate technical and organizational measures to protect personal data. All of seller's employees and its agents also are committed to protect personal customer's information.

13.6. The customer certifies that he has been informed about his rights. He can access his personal data and see how it is processed.

14. Final Provisions

14.1. All documentation between parties should be in written form. The parties agree that the sent message is treated as received after 96 hours from sending.

14.2. The seller has the right at any time to change or edit the rules and customer will be notified about these changes on accesing THERA.LT website. He will have to accept modifications if proceeding the order.

14.3. Registering on THERA.LT online store customer agrees that his personal data can be used for direct marketing purposes. At any time customer may object this without giving the reason for the disagreement. Agreement or disagreement is expressed in writing via e-mail.

14.4. Disputes related to the Agreement the parties will try to resolve through negotiations. Failing to do so everything will be by the courts of the Republic of Lithuania, according Lithuanian law.
